BRILO GAME – PAID PROMOTER TERMS & CONDITIONS

1. Introduction

These Paid Promoter Terms & Conditions (“Terms”) apply to all individuals (“Promoter”, “you”, “your”) participating in the Brilo Game Paid Promoter Program (“Program”), operated by Brilo Game (“Brilo”, “we”, “our”, “us”).
By participating in the Program, you agree to these Terms in full.


2. Eligibility

2.1 Promoters must be at least 18 years of age.
2.2 Promoters must be Australian citizens or residents.
2.3 Brilo may accept or reject applicants at its absolute discretion.
2.4 Continued participation requires ongoing compliance with these Terms.


3. Independent Promoter Status

3.1 Promoters are not employees, contractors, agents, or representatives of Brilo.
3.2 Promoters may not represent or imply any official capacity beyond sharing their unique promo code.
3.3 Promoters have no authority to bind Brilo legally or financially.
3.4 Promoters are responsible for their own taxation obligations related to commission earnings.


4. Promo Codes & Commission Structure

4.1 Each Promoter receives a unique promo code to share.
4.2 Commission is earned on confirmed ticket sales processed through the Promoter’s code.
4.3 Commission rates per event:
• $1.00 per confirmed ticket sale
• $1.50 per ticket after 80 sales (per event)
• $2.00 per ticket after 120 sales (per event)

4.4 Commission is paid per ticket, regardless of order grouping.
(Example: 1 Standard ticket + 1 Gift ticket = 2 commissions.)

4.5 Promo codes apply to General Admission, Final Release, and Gift Tickets.
4.6 Promo codes do not apply during the Early Bird period.
4.7 Promoters may not use their own promo code to purchase tickets.
4.8 Tickets must be fully paid, valid, and non-refunded to count as commissionable.
4.9 Brilo may audit any code usage and modify or withhold commissions in cases of fraud, misuse, or error.


5. Payments

5.1 Commissions are paid within 48 hours after the event ends.
5.2 The minimum payout threshold is $5; unpaid balances carry forward.
5.3 Payment method is via bank transfer to details provided by the Promoter.
5.4 Brilo is not responsible for delays due to incorrect banking information.
5.5 Brilo is not liable for delays caused by banking institutions, holidays, or system interruptions.
5.6 Brilo may hold or permanently withhold commissions arising from fraudulent or prohibited conduct.


6. Promoter Conduct & Posting Guidelines

Promoters must conduct themselves ethically, respectfully, and in a manner consistent with Brilo’s brand and values.

6.1 Content Standards

Promoters must not create, publish, or share promotional content that includes or encourages:

a) Offensive, explicit, hateful, or discriminatory language or imagery
b) Harassment, bullying, defamation, or personal attacks
c) Depictions of illegal, unsafe, or harmful behaviour
d) Content involving drugs, alcohol, criminal activity, or adult themes
e) Misleading claims about Brilo, the event, winnings, or rules
f) Alterations to Brilo’s official materials that misrepresent the event
g) False giveaways, fake prizes, or fabricated urgency
h) Claims suggesting guaranteed outcomes or winnings
i) Any content that Brilo, at its sole discretion, deems unsuitable


6.2 Player Eligibility Requirements 

Promoters may only share their promo code with individuals who meet all of the following:

  • Must be 18+ years old

  • Must be an Australian citizen or resident

  • Must purchase a valid ticket

  • Must comply with Brilo’s official Player Terms & Conditions

Promoters must not target or share their code with:

  • Minors

  • Individuals outside Australia

  • Individuals unwilling to purchase a valid ticket

  • Individuals attempting to bypass ID, age, or eligibility rules

  • Individuals who cannot legally participate

If a Promoter knowingly or negligently promotes to ineligible participants, Brilo may:

  • Terminate the Promoter immediately

  • Deactivate their promo code

  • Withhold unpaid commissions

  • Block future Program participation

Brilo’s interpretation of eligibility breaches is final.


6.3 Use of Brilo Materials

Promoters may use Brilo-provided promotional materials.
Promoters may post in their own style as long as all content remains accurate, respectful, and compliant with these Terms.


6.4 Removal Requests

Brilo may request removal or modification of any promotional content at any time.
Promoters must comply promptly.


7. Intellectual Property

7.1 All Brilo Game branding, artwork, materials, and assets remain the exclusive property of Brilo.
7.2 Promoters are granted a limited, revocable license to use approved materials solely for promoting Brilo events.
7.3 Promoters may not claim ownership of Brilo assets.
7.4 Upon termination, all Brilo materials must be removed and deleted.


8. Fraud, Misuse & Manipulation

The following actions constitute fraud or improper conduct:

a) Using one’s own promo code to generate personal commissions
b) Artificially inflating sales through fake accounts or bots
c) Coordinated misuse of promo codes
d) Encouraging ineligible participants
e) Misrepresenting event details to increase sales
f) Exploiting platform errors or loopholes
g) Any behaviour intended to deceive Brilo or players

Brilo retains full discretion to withhold commissions, revoke promo codes, or permanently terminate promoter access for any suspected misconduct.


9. Limitation of Liability

9.1 Brilo is not responsible for:

  • Loss of income or expected earnings

  • Promoter reputation damage

  • Platform outages or technical issues

  • Errors caused by third-party systems (Eventbrite, Kahoot, banking institutions)

  • Losses arising from incorrect information supplied by the Promoter

  • Consequential, incidental, or punitive damages

9.2 The Program is provided “as is” with no performance guarantees.
9.3 Brilo’s total liability is limited to the commission legitimately owed for valid ticket sales.


10. Indemnity

You agree to indemnify and hold harmless Brilo from all claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your promotional activities

  • Your content

  • Breach of these Terms

  • Misrepresentation of Brilo

  • Disputes between you and third parties

  • Legal claims arising from your conduct


11. Termination

11.1 Brilo may terminate any Promoter at any time, for any reason, without notice.
11.2 Immediate termination may occur for:

  • Fraud

  • Breach of conduct rules

  • Targeting ineligible participants

  • Content violations

  • Reputation risk

  • Legal threats

  • Any behaviour Brilo deems unsuitable

11.3 Upon termination, promo codes will be deactivated.
11.4 Unpaid commissions linked to breaches may be permanently withheld.


12. Dispute Resolution

12.1 All disputes must be submitted in writing to Brilo Game.
12.2 Brilo will review and provide a final decision.
12.3 Brilo’s determination regarding commission eligibility is final.


13. Governing Law

These Terms are governed by the laws of Western Australia.
Any disputes shall be handled exclusively in WA jurisdiction.


14. Amendments

Brilo may update or modify these Terms at any time.
Continued participation constitutes acceptance of updated Terms.
